Mediation and Conciliation

Harris Consulting is widely experienced in representing clients in mediation and/or conciliation forums that often lead to resolution of the dispute.

In consequence of the Woolf reforms to the Civil Procedure Rules there is in arbitration and litigation a newly placed emphasis on the parties attempting to resolve their dispute by mediation and/or conciliation prior to the implementation of formal dispute resolution processes.

Recent Work

As quantum expert, Harris Consulting was central to a local authority client team defending a claim in arbitration where the parties agreed to return to mediation to explore opportunities for settlement.
In a £14m claim for professional negligence, Michael was required to put its client's case to the Mediator & discuss the merits of the apparent case at the same time. This led to settlement of the dispute to a fraction of the sum claimed.
A main contractor’s claim against a Local Authority was pursued in litigation. Working closely with the Client’s lawyers Harris Consulting’s analysis of the merits of the claim led to a settlement in favourable terms to our client.
